Service Agreement
By and
between WhatIsMyHouseWorth.com, LLC and the WhatIsMyHouseWorth.com member (member
is the real estate agent signing the agreement), who will be referred to in
this agreement as “member.” The parties agree to the following, which shall
apply during the term of this agreement:
Prices: All prices are in US Dollars, and must be paid in full prior to
account modifications.
Cancellation of service: All service termination requires a full month
notice by the member, and all fees are non-refundable. WhatIsMyHouseWorth.com,
LLC reserves the right to cancel the membership of any member for any reason,
but is required to give a full month notice. In the event of cancellation by
WhatIsMyHouseWorth.com, LLC for any reason other than a violation of service
agreement, the annual membership fee will be refunded on a prorated basis.
Web Site User Privacy: All members agree to only use the information
provided to them by users of the WhatIsMyHouseWorth.com web site solely for the
purpose of the CMA request. In particular, members will not place users on any
sort of unsolicited e-mail list, bulk-mail distribution system, or in any way
send them correspondence, advertisements, or similar information via e-mail
which is not specifically requested. Failure to adhere to this policy will
result in immediate termination of the member’s account.
Membership Acceptance: All memberships are subject to approval by
WhatIsMyHouseWorth.com, LLC. A membership will be confirmed once the preceding
Annual Subscription Form has been received. A confirmation will be sent via
e-mail to the member acknowledging new membership.
Members
to receive first right to renew membership for the next year. Member is obligated to inform
WhatIsMyHouseWorth.com at least 30 days prior to expiration date of their
intention to renew membership. Members
agree to follow all state and federal laws concerning equal housing laws. Members agree to inform
WhatIsMyHouseWorth.com of any changes of information for their contact page.
Duties of WhatIsMyHouseWorth.com, LLC: WhatIsMyHouseWorth.com, LLC will be responsible
for the maintenance and upgrading of the WhatIsMyHouseWorth.com web site,
including the development of all software necessary for communication with both
agents and users.
Limitations of liability: WhatIsMyHouseWorth.com, LLC will utilize its
best efforts to maintain acceptable performance of services contracted for, but
makes absolutely no warranties whatsoever, express or implied, including
warranty of merchantability or fitness for a particular purpose.
WhatIsMyHouseWorth.com, LLC cannot guarantee continuous service, service at any
particular time, or integrity of data stored or transmitted via its system or
via the Internet. WhatIsMyHouseWorth.com, LLC is not in the business of
providing technical support for systems external to its control, including but
not limited to internet connectivity, e-mail software support, and web browser
support. WhatIsMyHouseWorth.com, LLC will not be liable for the inadvertent
disclosure of, or corruption or erasure of, data transmitted or received or
stored on its system. WhatIsMyHouseWorth.com, LLC shall not be liable to the
member for any claims or damages which may be suffered by the member,
including, but not limited to, losses or damages of any and every nature,
resulting from the loss of data, inability to access Internet, or inability to transmit
or receive information, caused by, or resulting from, delays, nondeliveries, or
service interruptions whether or not caused by the fault or negligence of
WhatIsMyHouseWorth.com, LLC.
